Enforcement against States and state entities: EU law as a defence against enforcement

Issues to be addressed

Is refusing to enforce an award on the basis of EU law a breach of a State’s international law commitments under the Washington Convention and the New York Convention?

Will EU courts refuse enforcement of commercial arbitration awards against States if the dispute arises out of a contract which can be classified as "investment contract"?

Which law applies to review enfocement of an award against a State in these cases? What is the relationship between EU and public international law?

Are national courts sitting outside EU obliged to take account of CJEU's jurisprudence?

Can national courts in EU refuse enforcement of awards against non-EU States which many rely on CJEU jurisprudence?

Review of Arbitral Awards by National Courts

Issues to be addressed

Public policy, mandatory rules and extent of review of arbitral awards.

Extent of review of awards by national courts: a retrial or an appeal? I.e. can you bring new claims and arguments at enforcement stage? Can you bring new evidence at enforcement stage? Is the enforcement court bound by the factual findings of the tribunal?

Review of reasoning of awards? How far can a national court review coherence and adequacy of reasoning?

How far can enforcement courts review awards which have been already confirmed by courts of the seat of arbitration?
