Enforcement against States and state entities: EU law as a defence against enforcement+
- Is refusing to enforce an award on the basis of EU law a breach of a State’s international law commitments under the Washington Convention and the New York Convention?
- Will EU courts refuse enforcement of commercial arbitration awards against States if the dispute arises out of a contract which can be classified as "investment contract"?
- Which law applies to review enfocement of an award against a State in these cases? What is the relationship between EU and public international law?
- Are national courts sitting outside EU obliged to take account of CJEU's jurisprudence?
- Can national courts in EU refuse enforcement of awards against non-EU States which many rely on CJEU jurisprudence?
